Signature Bail Bonds in Phoenix: No Collateral Bonds

For qualified cosigners, many bonds can be written on a signature alone, with no property or cash collateral.

Signature Bail Bonds in Phoenix: What You Need to Know

A signature bond, in bail bond industry terms, is a surety bond written without collateral. The cosigner's signature on the indemnity agreement, backed by stable employment, residence and credit, is the security. For many misdemeanor and lower felony bonds in Maricopa County, a qualified cosigner can obtain a signature bond and pay only the premium.

Note that courts also use the phrase 'signature bond' for an unsecured appearance bond, where the defendant promises to pay an amount if they miss court but no money changes hands. We explain the difference so there is no confusion about what the court ordered and what you are being asked to sign.

How We Handle Signature Bail Bonds

1

Step 1

We confirm the bail amount and ask a few questions about the cosigner: employment, residence history and relationship to the defendant.

2

Step 2

If the cosigner qualifies, the bond is written on signature. If not, we discuss a second cosigner, a payment plan or collateral.

3

Step 3

We post the bond and track the release.

What a Bail Bond Costs in Arizona

Arizona bail bond premiums are set by the surety company's rate filing with the Arizona Department of Insurance and Financial Institutions. The standard rate is 10% of the bail amount, so a $5,000 bail costs about $500 and a $20,000 bail costs about $2,000. The premium is our fee for posting the full bail and is not refunded when the case ends. Arizona law does not allow a bail agent to charge interest on the premium, and we never add night, weekend or holiday surcharges.

On very small bonds, surety schedules set a minimum premium. If paying the full cash bond yourself would cost you less, we will say so. For larger bonds we may ask for collateral or a qualified cosigner, and every requirement is disclosed in writing before you commit. Use our bail bond calculator to estimate the premium, or read about payment plans and collateral.

Signature Bail Bonds Questions

Who qualifies for a signature bail bond?

Generally a cosigner with steady employment, a stable Arizona residence, and a relationship to the defendant that suggests they will make sure the person appears in court. The bail amount matters too; very large bonds usually require collateral.

Is a signature bond the same as being released on your own recognizance?

No. Own recognizance means the court released the person on a promise to appear with no bond at all. A signature bail bond is a surety bond we post on the person's behalf, secured by the cosigner's signature instead of collateral.

Does the cosigner have to pay the full bail if the person misses court?

If the defendant fails to appear and is not returned within the time the court allows, the bond can be forfeited and the cosigner is responsible for the full amount plus recovery costs under the indemnity agreement. That is why cosigning is a serious commitment.

What happens if you cosign a bail bond?

You sign an indemnity agreement promising that the defendant will appear at every court date. You pay or arrange the premium and any collateral. If the defendant appears as required, your obligation ends when the case concludes and the bond is exonerated. If the defendant fails to appear and is not returned to custody, you are responsible for the full bail amount and recovery expenses.
