Arizona Bail Bond Questions

How do bail bonds work in Arizona?

After an arrest in Arizona, a judicial officer sets release conditions at the initial appearance within 24 hours. If a secured appearance bond is set, you can pay the full amount in cash to the court, or hire a licensed bail bond agent. The agent charges a premium set by filed surety rates, typically 10% of the bail, posts the full bond with the court, and the person is released. The premium is the agent's fee and is not refunded; a cash bond paid directly to the court is refunded if the person appears at every hearing.

Do you get bail bond money back?

The premium paid to a bail bond agent is not refunded. It is the fee for the agent posting the full bail amount on the defendant's behalf. Collateral pledged for a bond is returned when the case ends and the court exonerates the bond. If you instead pay the full bail in cash directly to the court, that cash is refunded when the case concludes, provided the defendant appeared at every court date.

How much does a bail bond cost in Phoenix?

Arizona bail bond premiums are set by the surety company's rates filed with the Arizona Department of Insurance and Financial Institutions, typically 10% of the bail amount. A $5,000 bail costs about $500; a $25,000 bail costs about $2,500. Surety schedules set a minimum premium on very small bonds. Licensed agents cannot charge interest on the premium, and we disclose every fee before you sign.

How long after posting bail is someone released from Maricopa County jail?

The Maricopa County Sheriff's Office states that release processing can take up to 24 hours after a bond is posted. In practice, release from the 4th Avenue Jail often takes two to eight hours, and releases from the Durango complex jails (Lower Buckeye, Estrella, Towers, Watkins) can take longer because the release order must reach that facility. Weekend nights and holidays are slowest.

What happens if you skip bail in Arizona?

The court issues a bench warrant for the defendant's arrest and begins bond forfeiture. The bail agent has a period to return the defendant to custody. If the defendant is not returned, the bond is forfeited and the cosigner owes the full bail amount plus recovery costs under the indemnity agreement. The defendant also faces a new charge of failure to appear.

What happens if you cosign a bail bond?

You sign an indemnity agreement promising that the defendant will appear at every court date. You pay or arrange the premium and any collateral. If the defendant appears as required, your obligation ends when the case concludes and the bond is exonerated. If the defendant fails to appear and is not returned to custody, you are responsible for the full bail amount and recovery expenses.

Can a cosigner be removed from a bail bond?

A cosigner can ask the bail agent to surrender the defendant back to custody, which ends the bond and the cosigner's future liability, although the premium is not refunded. A cosigner cannot simply withdraw while the defendant remains free on the bond. Talk to us before taking that step; often a conversation with the defendant and the attorney solves the problem.

What is the difference between bail and bond?

Bail is the amount of money the court requires as a guarantee that the defendant will return to court. A bond is the instrument used to satisfy it: a cash bond is the full amount deposited with the court, and a surety bond (bail bond) is a licensed agent's guarantee to pay the full amount if the defendant fails to appear, in exchange for a nonrefundable premium.

How do I find out someone's bail amount in Maricopa County?

Search the Maricopa County Sheriff's Office inmate information system by name and date of birth or booking number; it lists the booking charges and bond amount once the initial appearance has occurred. Or call us at any hour and we will look it up and explain the release conditions.

How can I bail someone out of jail without money?

Options include asking the court or a defense attorney to request release on own recognizance or a lower bond, using a bail bond agent with a payment plan for the premium, or pledging collateral such as a vehicle title in place of cash. We offer payment plans to qualified cosigners and explain all options honestly.

What does released on own recognizance mean?

It means the court released the defendant on a written promise to appear, without requiring any money or bond. Judges grant own recognizance release for many first-time misdemeanors and some lower felonies when the person has community ties and no history of missing court. Conditions such as pretrial services check-ins may still apply.

What happens at an initial appearance in Maricopa County?

Within 24 hours of arrest, the defendant appears before a judicial officer, who informs them of the charges, confirms identity and address, considers the state's and defense's input, and sets release conditions: own recognizance, pretrial services, an unsecured bond, a secured appearance bond that can be posted in cash or by a bail agent, or a cash-only bond. Later court dates are also set.

Which jails are in Maricopa County?

The Maricopa County Sheriff's Office operates the 4th Avenue Jail downtown (intake and initial appearances), and the Durango complex in west Phoenix: Lower Buckeye Jail, Estrella Jail (women), Towers Jail, Watkins Jail, and the Intake, Transfer and Release facility. Many Valley cities also run short-term holding facilities for their own police arrests. Our jails guide also covers every other county jail in Arizona, from Pima and Pinal to Mohave and Cochise.

Where do you post bail in Phoenix?

Bonds for anyone in Maricopa County custody are posted in person at the 4th Avenue Jail Bond and Fine Room, 201 S 4th Avenue, Phoenix, at the northwest corner of the building. The county does not accept bonds electronically. Our agent handles the posting so you do not have to.

How do I check if I have a warrant in Arizona?

Maricopa County Superior Court and Justice Court records are searchable online, and the Arizona Judicial Branch public access site covers most courts statewide. A licensed bail agent can also check discreetly and arrange a walk-through bond so you can clear the warrant without a long stay in jail.

How do I choose a bail bondsman in Phoenix?

Confirm the agent is licensed by the Arizona Department of Insurance and Financial Institutions, ask for the premium rate in writing, make sure every fee is disclosed before you sign, avoid anyone who solicits you at the jail or promises to 'negotiate' bail, and choose an agency that answers its own phone 24 hours a day.

How do I avoid bail bond scams?

The Maricopa County Sheriff's Office never requests bond payment by phone, text, email or payment app. Neither does any court. Deal only with a licensed agent, get everything in writing, never pay a 'release fee' to a stranger, and never wire money or buy gift cards to free someone from jail.
