How Old Do You Have to Be to Bail Someone Out of Jail?

You have to be at least 18 years old to bail someone out of jail, because posting a bond or cosigning one is a legal contract.

Quick answer

You have to be at least 18 years old to bail someone out of jail, because posting a bond or cosigning one is a legal contract. In Arizona a bail agent requires the cosigner to be an adult with ID, a verifiable address and income, and a relationship to the defendant.

Why 18 is the line

Bailing someone out means signing a contract. If you post a cash bond at the window, you are the person the court refunds or forfeits money to. If you use a bail agent, you sign an indemnity agreement promising to pay the full bail amount if the defendant does not return to court. A minor cannot be bound by that kind of agreement, so no licensed agent in Arizona will accept a cosigner under 18.

There is no upper age limit. A grandparent on a fixed income can cosign if the income is verifiable. What the agent is checking is not age for its own sake but the ability to stand behind the bond: a government ID, a stable address, income and a real connection to the defendant. The cosigner guide lists what to have ready.

What a cosigner needs besides being an adult

  • A valid government-issued photo ID
  • A verifiable home address, in Arizona or any other state
  • Income the agent can confirm, such as pay stubs or a job the agent can verify
  • A relationship to the defendant: family, partner, employer or close friend
  • A debit or credit card for the premium, or a down payment under a payment plan

Most bonds under about $25,000 are written on a signature with one qualified cosigner and no collateral. Larger bonds, or a cosigner with thin income, may need a second cosigner or collateral such as a vehicle title. An 18-year-old with a part-time job and no history is a weak cosigner on a large bond, but may be enough on a small one. The agent will say so plainly rather than take a premium on a bond that will not be approved.

Teenagers, young adults and who else can step in

If the only person available is under 18, the practical answer is to find an adult. A parent, older sibling, aunt, uncle, employer or family friend can cosign. The cosigner does not have to live in Arizona; out-of-state cosigners sign electronically and pay by card every day. The cosigner also does not have to be related by blood, only able to vouch for the defendant and meet the financial check.

If the defendant is the one under 18, the case is in juvenile court, which uses a different release system, and bail bonds generally do not apply. Someone who is 18 or 19 and arrested is an adult in the eyes of the criminal court, and their parents are the usual cosigners. Cosigning is not reported to credit bureaus unless a forfeiture becomes a judgment, which our FAQ explains in more detail.

Related Questions

Can a 17 year old bail someone out of jail?

No. A 17-year-old cannot sign the indemnity agreement a bail agent requires, and cannot be held to a cash bond receipt in the same way. An adult relative or friend who is 18 or older needs to be the cosigner or post the cash bond.

Can an 18 year old cosign a bail bond?

Yes, if the person has a valid ID, a verifiable address and some income. Agents look at the whole profile, so an 18-year-old may qualify for a small signature bond but need a second cosigner or collateral on a larger one.

Who can bail a minor out of jail?

Minors in Arizona are handled in juvenile court, which uses detention hearings and release to a parent or guardian rather than money bail. A bail agent generally cannot help with a juvenile case. If the arrested person is 18 or older, they are in adult court and a bond may apply.

Does a cosigner have to be a family member?

No. Any adult with ID, a verifiable address and income, and a genuine relationship to the defendant can cosign. Employers, partners and close friends cosign regularly. The agent needs to see that the cosigner has a real reason to make sure the person goes to court.

Can you bail yourself out if you are 18?

Yes. An adult defendant can post their own cash bond or, if an agent accepts the risk, sign their own bond. Most agents still want an outside cosigner with income, since the defendant cannot easily pay from custody. Call One Stop Bail Bonds any hour and an agent will walk you through it.
