How Is Bail Bond Collateral Documented and Returned?

Bail bond collateral is documented with a written collateral receipt and listed in the indemnity agreement, then returned when the court exonerates the bond.

Quick answer

Bail bond collateral is documented with a written collateral receipt and listed in the indemnity agreement, then returned when the court exonerates the bond. In Arizona a vehicle title is held physically, real estate is secured by a recorded deed of trust, and cash is held in a trust account until the case ends.

What paperwork you should receive when you pledge collateral

Two documents matter. The indemnity agreement describes the bond, the premium, the cosigner's promise to pay the full bail if the defendant does not appear, and the collateral pledged to back that promise. The collateral receipt lists each item with enough detail to identify it: the vehicle identification number and title number, the legal description or address of the property, the amount of cash. It states the conditions for return and the time frame.

Read both before signing and keep copies. If the agency cannot produce a receipt for an item it holds, ask for one before leaving. Licensed agents are regulated under Title 20 by the Arizona Department of Insurance and Financial Institutions, and the receipt is what the regulator expects to see. Our collateral page lists what we accept and how it is held.

How each type of collateral is held during the case

A vehicle title is held physically in the agency's files; the family keeps driving the car. Real estate is secured by a deed of trust recorded with the county recorder, which creates a lien and nothing more; nobody moves, and no payment is due on it. Cash collateral is deposited in a trust account separate from the agency's operating money. Other valuables are stored securely.

Collateral is not spent. It sits as security for the full bail amount in case of forfeiture. Most bonds under about $25,000 are written on a signature with a qualified cosigner and need no collateral at all; it is the larger bonds and the thinner cosigner profiles where collateral comes in.

When and how collateral is returned

The bond ends when the case ends and the court exonerates it: dismissal, acquittal, plea, or sentencing. The court sends the exoneration order to the surety, and the agency then releases the lien or returns the item within the time stated in the agreement, usually within a few weeks of receiving the order. Bring the agency a copy of the exoneration order yourself; it often arrives faster than the mailed copy.

For real estate the agency records a release of the deed of trust. For a title, the family picks it up or receives it by tracked mail. Cash is returned from the trust account, less any unpaid premium balance if the agreement says so. Read the cosigner guide for how exoneration ends the cosigner's liability at the same time.

Does a bail bondsman keep the title to my car?

The agency holds the paper title in its files as security while the bond is in force. You keep the car and keep driving it. When the court exonerates the bond, the title is returned. It is at risk only if the defendant misses court and is not returned.

How long does it take to get collateral back after a bail bond?

Usually a few weeks after the agency receives the court's exoneration order. The agreement states the exact time frame. Delivering a copy of the order to the agency yourself is the fastest way to start the clock, since court mail can take longer.

What happens to collateral if the defendant skips bail?

The court begins forfeiture, and if the defendant is not returned before judgment, the agency pays the full bail and uses the collateral to recover it under the indemnity agreement. A house secured by a deed of trust can be foreclosed, and a vehicle can be sold.

Can a bail bond company sell my collateral early?

Not while the bond is in good standing. Collateral may be liquidated only after a forfeiture judgment or as the indemnity agreement allows for an unpaid balance. If an agency sells or refuses to return collateral without cause, complain to the Arizona Department of Insurance and Financial Institutions.

Do I get a receipt for cash collateral on a bail bond?

Yes. Every item of collateral, including cash, should be listed on a written collateral receipt with the conditions for return. Cash is held in trust, not mixed with the agency's funds. Never pledge collateral without a receipt. Call One Stop Bail Bonds any hour and an agent will walk you through it.
