How Do You Get Someone Out of Jail Without Bail?

You can get someone out of jail without bail if the judge releases them on own recognizance, to pretrial services, or on an unsecured bond, none of which require money.

Quick answer

You can get someone out of jail without bail if the judge releases them on own recognizance, to pretrial services, or on an unsecured bond, none of which require money. In Arizona a defense attorney can ask the court for those options at the initial appearance or at a later review.

Release options that cost nothing

Arizona judges choose release conditions under A.R.S. 13-3967, and three of the options involve no money up front. Own recognizance is a written promise to appear. Pretrial services adds supervision such as check-ins or testing. An unsecured appearance bond names an amount the person owes only if they miss court. First-time misdemeanor defendants with a local address and job are commonly released on one of these at the initial appearance.

These decisions are made by the judge, usually within 24 hours of arrest at the Initial Appearance Court in the 4th Avenue Jail. Family can often watch remotely. Having the person's employer, address and family ties ready for the defense attorney helps, because those are the factors the statute lists. Our guide to own recognizance release explains who typically qualifies.

Asking the court to change the bond

If a secured bond was set and nobody can post it, the amount is not final. A defense attorney can file a motion to modify release conditions, and the court reviews bail under Rule 7.4. Judges often reduce bail at or after arraignment when they hear more about employment, residence and history, and they can convert a secured bond to OR or pretrial supervision. The prosecutor and any victim are heard too.

A bail agency cannot file that motion or argue it; only an attorney can. We mention it because families sometimes pay a premium on a bond that an attorney could have had reduced days later. If a modification is coming, ask the attorney about timing. If the bond is lowered to something manageable, a signature bond with no collateral may then be an option.

Other paths out without a bond

No charges filed: if the prosecutor does not file a complaint by the initial appearance, the judge typically releases the person with a future court date or outright. A summons or warrant issues later if charges are filed.

Case resolved: a dismissal, a plea with a sentence of time served or probation, or an acquittal ends custody without any bond.

Holds cleared: sometimes the only thing keeping a person in jail is a probation hold, a warrant from another court, or an immigration detainer. Clearing the hold, through the probation officer, the issuing court or federal process, is what releases the person, and a bond on the new charge would not. A licensed agent can read the custody record and tell you whether a bond would actually lead to release or whether the real obstacle is a hold. The bailing someone out without money guide covers each path.

Related Questions

How do you get out of jail without paying?

Through a release order that does not require money: own recognizance, pretrial services supervision, or an unsecured appearance bond. The judge decides at the initial appearance. If a secured bond is set instead, a defense attorney can ask the court to modify it later.

Can a judge release someone without bail in Arizona?

Yes. A.R.S. 13-3967 directs judges to release a person charged with a bailable offense on the least restrictive conditions that ensure appearance and safety. Own recognizance is the default for many first-time, low-level cases, and judges use it every day in Maricopa County.

What is a bond reduction hearing?

A hearing where a defense attorney asks the judge to lower a bond or change release conditions, and the prosecutor responds. Judges consider the factors in A.R.S. 13-3967, including ties to the community, history and the nature of the offense. Bail is often reduced at arraignment.

Can you get out of jail with no money and no cosigner?

Only through the court: OR release, pretrial services, an unsecured bond, a dismissal or no charges being filed. A surety bond needs a premium and a qualified cosigner. A defense attorney, including an appointed public defender, can request a no-money release.

Does pretrial services release cost anything?

Pretrial release itself has no bond amount. Supervision may involve drug testing or monitoring with program costs set by the county, which a defense attorney can explain. It is a court program, not a bail product. Call One Stop Bail Bonds any hour and an agent will walk you through it.
