Where Does Bail Money Go?
Bail money goes to the court, which holds it as security until the case ends and then refunds it to the person who posted it.
Quick answer
Bail money goes to the court, which holds it as security until the case ends and then refunds it to the person who posted it. A bail bond premium is different: it goes to the licensed bail agent as a nonrefundable fee, typically 10% of the bail, and the agent's surety guarantees the rest.
Where a cash bond goes
A cash bond paid at the 4th Avenue Jail Bond and Fine Room or at the court clerk's office is held by the court. The county does not spend it. It sits there as security for the defendant's appearance for the life of the case, which can be months, sometimes more than a year on a serious felony.
When the case concludes and the court exonerates the bond, the clerk refunds the money to the person named on the receipt. The court can first apply it to fines, fees or restitution ordered against the defendant. If the defendant fails to appear and is not returned, forfeiture under A.R.S. 13-3974 lets the court keep the money instead. See the bail money refund guide for timing.
Where a bail bond premium goes
When you hire a licensed agent, you do not pay the bail amount at all. You pay a premium, typically 10%, set by surety rates filed with the Arizona Department of Insurance and Financial Institutions. That premium is the agent's fee. A portion goes to the surety insurance company that backs the bond, and the rest covers the agency's operation and the risk of forfeiture.
The premium is earned when the bond posts and the defendant is released. It is not refunded when the case ends, no matter the outcome. Licensed agents may not charge interest on it or add surcharges for nights, weekends or holidays. Use the bail bond calculator to see the premium on any bail amount before you call.
Where collateral goes
Collateral is the third category and the one people confuse most. If a bond requires it, a vehicle title, deed or cash deposit is held by the agency, not spent and not sent to the court. It secures the cosigner's promise under the indemnity agreement. Many bonds under about $25,000 need no collateral at all.
When the court exonerates the bond, the agency returns the collateral. It is at risk only if the defendant skips court and is not returned within the period the court allows, at which point the surety pays the court and recovers from the cosigner. Read the collateral page for what we accept and how it is released.

Related Questions
Does the bail bondsman keep the bail money?
The bondsman never holds the bail amount itself. The agent posts a surety bond, a promise to pay the court if the defendant skips. The agent keeps only the premium, typically 10%, as the fee for taking on that risk.
Does the court keep bail money if you are convicted?
Not automatically. A cash bond is refunded after the case ends if the defendant appeared at every hearing, regardless of a conviction. The court may deduct fines, fees and restitution ordered at sentencing before mailing the balance to the person on the receipt.
Who gets bail money when someone skips court?
After forfeiture under Rule 7.6 and A.R.S. 13-3974, the court keeps a cash bond. On a surety bond the insurer pays the court, then the agency collects the full amount plus recovery costs from the cosigner under the indemnity agreement.
Does bail money go to the victim?
Not directly. Bail secures appearance and is refunded or forfeited on that basis. At sentencing a court can order restitution to a victim and may apply a refundable cash bond toward it, but a surety bond premium never goes to a victim.
Where does the bail money come from on a bond?
From the surety insurance company that appoints the agent. The company guarantees the full amount to the court, and the cosigner guarantees the company through the indemnity agreement. Call One Stop Bail Bonds any hour and an agent will walk you through it.
