Arizona Bail Guide
Do You Get Bail Money Back? Cash Bonds vs. Bail Bond Premiums
Whether bail money is refunded in Arizona depends on how it was posted: cash bonds are returned when the case ends, bail bond premiums are not. Here is the full picture.
Cash Bond: Refundable
If you pay the full bail amount in cash to the court or jail, that money is held as security. When the case ends and the defendant has appeared at every hearing, the court refunds it, sometimes minus fines, fees or restitution the court applies. Refund processing can take weeks.
Bail Bond Premium: Not Refundable
If you hire a bail agent, you pay a premium, typically 10% of the bail, and the agent posts the full amount. The premium is the fee for that service and is earned when the bond is posted. It is not returned at the end of the case, whether the charges are dismissed, the person is acquitted or convicted.
Collateral: Returned
Collateral pledged for a bond, such as real estate or a vehicle title, is held, not spent, and is returned when the court exonerates the bond. It is at risk only if the defendant fails to appear and is not returned.
Which Is Better?
If you can comfortably pay the full bail in cash and get it back later, a cash bond costs less overall. Most families cannot, or cannot without putting rent and bills at risk. A surety bond lets you post a $20,000 bail for $2,000. We will tell you honestly which makes sense for the amount involved.

Questions
Do I get the premium back if the charges are dropped?
No. The premium is earned when the bond is posted and the person is released. The outcome of the case does not change that.
How long does it take to get a cash bond back from Maricopa County?
The court processes refunds after the case concludes and the bond is exonerated; several weeks is common. Ask the court clerk for the current timeline.
What if the defendant misses court on a cash bond?
The court can forfeit the cash bond after notice, meaning the money is kept. A defense attorney can ask the court to set aside the forfeiture if the person returns promptly with a good explanation.
