Bench Warrants in Arizona: What They Are and How to Clear One

What an Arizona bench warrant is, why courts issue them for missed court dates or unpaid fines, and how a walk-through bond or motion to quash clears one.

What a Bench Warrant Is

A bench warrant is issued by a judge from the bench, usually because a defendant failed to appear for a court date, failed to pay a fine, or violated a release condition. It authorizes any officer to arrest the person and bring them before the court. Unlike an arrest warrant for a new crime, a bench warrant is about the existing case.

What Happens When It Is Served

Most bench warrants are served during traffic stops or other police contact. The person is booked into the 4th Avenue Jail or a city facility and held until the court addresses the warrant, which on a Friday night can mean the whole weekend. Courts often set a higher bond, or a cash-only bond, on a failure-to-appear.

Clearing a Bench Warrant

There are two paths. A defense attorney can file a motion to quash the warrant and reset the court date, which many courts grant for first missed dates with a good explanation. Or you surrender on the warrant with a pre-arranged walk-through bond, are booked, bonded and released in hours, with a new court date in hand.

Bench Warrants and Existing Bonds

If you were already out on a bond we posted and you miss court, the court begins forfeiture. Call us immediately. Getting you back in front of the judge quickly usually saves the bond and protects your cosigner.

Bench Warrants Questions

How much is bail on a bench warrant in Maricopa County?

It varies by court and case. Some failure-to-appear warrants carry a modest bond; courts may also set a cash-only bond or no bond on repeat failures. We confirm the amount before you surrender.

Can I just pay the fine to clear a bench warrant?

On some failure-to-pay warrants in municipal and justice courts, paying the fine or appearing at the court window resolves it. On failure-to-appear warrants in criminal cases, you generally must appear before the judge or surrender on the warrant.

Is failing to appear a separate crime?

It can be. Arizona law allows a separate failure-to-appear charge in addition to the warrant, which is another reason to resolve a missed date quickly.

How do I check if I have a warrant in Arizona?

Maricopa County Superior Court and Justice Court records are searchable online, and the Arizona Judicial Branch public access site covers most courts statewide. A licensed bail agent can also check discreetly and arrange a walk-through bond so you can clear the warrant without a long stay in jail.
