Bail vs. Bond: What Is the Difference?
Bail is the amount the court requires; a bond is how it gets paid. A plain-English explanation of bail, cash bonds, surety bonds, appearance bonds and bail bondsmen.
Bail
Bail is the amount of money a court requires as a guarantee that a defendant will return for court. The judge sets it at the initial appearance. Bail is not a fine and is not punishment; it is security for appearance.
Bond
A bond is the instrument that satisfies the bail. A cash bond is the full amount deposited with the court. A surety bond, commonly called a bail bond, is a licensed agent's guarantee, backed by an insurance company, to pay the full amount if the defendant fails to appear. An appearance bond is the court's name for the defendant's written promise with an amount attached; it can be secured (money must be posted) or unsecured (money owed only on default).
Bail Bondsman
A bail bond agent is licensed by the Arizona Department of Insurance and Financial Institutions to write surety bonds for a premium. The agent posts the bond, the defendant is released, and the agent is responsible to the court if the defendant disappears.
Why the Words Get Mixed Up
People say 'post bail' and 'post bond' to mean the same thing: getting someone out. The distinction matters when reading a release order: 'secured appearance bond $5,000' means a cash or surety bond; 'cash only' means no surety; 'own recognizance' means no money at all. See how bail bonds work.

Who decides bail vs. own recognizance?
The judicial officer at the initial appearance, applying A.R.S. 13-3967.
