Arizona Bail Guide
How Much Is Bail for a DUI in Arizona?
Typical bail for misdemeanor DUI, extreme DUI and aggravated (felony) DUI in Maricopa County, what affects the amount, and what a bond costs.
Misdemeanor DUI
Many first-offense misdemeanor DUI arrestees in Maricopa County are released after booking on their own recognizance or to pretrial services, with no monetary bond. When a bond is set, it is often in the low thousands. Extreme DUI (0.15 BAC and above) and super extreme DUI (0.20 and above) can bring higher bonds, as can a prior DUI within 84 months.
Aggravated DUI (Felony)
Under A.R.S. 28-1383, DUI on a suspended or revoked license, a third DUI in 84 months, DUI with a child under 15 in the car, or DUI while required to have an interlock is a felony. Bail commonly ranges from a few thousand dollars to $25,000 or more, depending on history and circumstances, and the case is filed in Superior Court.
What Affects the Amount
The judge weighs criminal history, prior failures to appear, the BAC, whether there was an accident or injury, employment and residence, and the prosecutor's request. An attorney at the initial appearance can make a real difference.
What the Bond Costs
The premium is typically 10% of the bail: $500 on a $5,000 bond, $1,500 on $15,000. Payment plans are available to qualified cosigners. See our DUI bail bonds page and calculator.

Questions
Is bail higher for a DUI with an accident?
Usually. An accident, especially with injury, raises the seriousness of the offense and often the bond, and injury cases may be charged as aggravated assault.
Will the person lose their license at release?
Arizona's admin per se process starts at arrest and runs separately from the criminal case, with a short deadline to request an MVD hearing. Talk to a DUI attorney immediately.
Can an out-of-state driver bond out and go home after a Phoenix DUI?
Typically yes, subject to release conditions and the requirement to return for court or appear through counsel where allowed. We handle out-of-state DUI bonds regularly.
